By accessing and using Hanashi ("the App"), you accept and agree to be bound by the terms and provision of this agreement.

2. About Hanashi

Hanashi is an AI-powered Japanese language learning application that provides conversational practice through artificial intelligence. The service is operated by Hanashi, a company incorporated in Ireland.

3. Data Collection and Privacy

We store user data that you enter into the App, including but not limited to:

• Voice recordings and audio data
• Text conversations and messages
• Learning progress and preferences
• Account information and usage statistics

Your data is stored securely and is never shared with third parties. We use industry-standard security measures to protect your information.

We work with OpenAI to provide AI-powered language learning features. Data sent to OpenAI is processed according to their privacy policy and terms of service.

4. Prohibited Uses

You may not use Hanashi:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

5. Third-Party Services

Hanashi integrates with OpenAI's services to provide AI-powered conversation features. Your use of these integrated services is also subject to OpenAI's terms of service and privacy policy. We are not responsible for the practices or content of these third-party services.

6. Disclaimer

The information in Hanashi is provided on an 'as is' basis. To the fullest extent permitted by law, Hanashi excludes all representations, warranties, conditions and terms whether express or implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitations

In no event shall Hanashi or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Hanashi, even if Hanashi or an authorized representative has been notified orally or in writing of the possibility of such damage.

8. Accuracy of Materials

The materials appearing in Hanashi could include technical, typographical, or photographic errors. Hanashi does not warrant that any of the materials are accurate, complete, or current. Hanashi may make changes to the materials at any time without notice.

9. Modifications

Hanashi may revise these terms of service at any time without notice. By using this App, you are agreeing to be bound by the then current version of these terms of service.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Ireland.

11. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
